Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Sofol Digital (“we”, “us”, “our”) for your use of the TuckTime app and the tucktime.app website (together, the “Service”). Please read them alongside our Privacy Policy. By downloading, accessing, or using TuckTime, you agree to these Terms. If you don’t agree, please don’t use the Service.
In short. TuckTime is a bedtime-story app for a parent to use with their child. You need to be an adult to set it up. Some custom-story features need a paid subscription; preset themes are always free. Be kind in what you create, and only record people who are okay with being recorded.
1. Who can use TuckTime
You must be at least 18 years old and able to form a binding contract to create an account. TuckTime is designed for an adult parent or guardian to set up and operate for use with their own child. A child does not create an account or use the app on their own. By using TuckTime you confirm you are the parent or guardian of any child you set up a profile for, and that you have the authority to provide that information.
2. Your account
You sign in with Sign in with Apple. You’re responsible for keeping access to your Apple account secure and for activity that happens under your TuckTime account. Tell us promptly if you believe your account has been used without your permission.
3. The Service
TuckTime lets you create gentle, personalised bedtime stories, read them aloud while the words highlight in time, record your reading in your own voice, and replay those recordings. Stories are generated with the help of an AI text provider and are drawn from a shared, pre-moderated, first-party library. Stories are intended for calm, entertaining bedtime reading; they are not factual, educational, medical, or professional advice, and you should not rely on them as such.
4. Subscriptions and payments
- Free forever: the preset story themes are free and unlimited.
- TuckTime Plus: the custom “Something else” story composer requires a paid subscription, available as a monthly or annual plan. The current price for your region is shown in the app at the point of purchase. There is no free trial.
- One subscription per household: a single TuckTime Plus subscription covers every co-parent in your household.
- Billing: purchases are processed by Apple through your Apple account. Subscriptions auto-renew until cancelled. You can manage or cancel at any time in your device’s Settings → your name → Subscriptions; cancellation takes effect at the end of the current period.
- Refunds: purchases are handled by Apple and are subject to Apple’s refund policies. We generally cannot issue refunds directly for App Store purchases.
- Prices and plans may change; we’ll give notice of changes as required, and price changes won’t apply to a period you’ve already paid for.
5. Acceptable use
You agree not to:
- use TuckTime for anything unlawful, harmful, or that infringes others’ rights;
- enter another person’s personal information into a custom story without their consent, or include content that is hateful, sexual, violent, or otherwise inappropriate for a children’s app;
- record people who haven’t agreed to be recorded — you are responsible for the recordings you make and for the consent of anyone who can be heard in them;
- attempt to break, probe, overload, reverse-engineer, or circumvent the Service’s security or access controls, or use it to access data that isn’t yours;
- misuse the invite/household feature, or invite people into your household without a genuine family relationship and their agreement.
We use automated safety checks on generated and custom content, and may hide or remove content and suspend accounts that breach these Terms.
6. Your content
Recordings and inputs. You keep ownership of the recordings you make and the inputs you provide. You grant us a limited licence to store, process, and transmit your content solely to provide the Service to you and your household (for example, to save a recording and play it back, or to generate a story from your inputs). We do not use your recordings or inputs to train AI models, and we do not sell or share them. You’re responsible for ensuring you have the right to record and submit the content you provide.
Generated stories. Generated stories form a shared, first-party library. We grant you a personal, non-exclusive licence to read and replay stories within TuckTime for your family’s personal, non-commercial use. AI-generated text can occasionally be wrong or imperfect; stories are provided for bedtime enjoyment, not accuracy.
7. Co-parent households
You can invite another parent into your household via a private link. Anyone who joins gains co-equal access to the household’s children, recordings, ratings, and favourites. Only invite people you trust and intend to share your family’s data with. You’re responsible for who you invite. A member can leave a household at any time from within the app.
8. Intellectual property
TuckTime, including the app, the tucktime.app website, the name, logo, design, and the shared story library (excluding your own recordings and inputs), is owned by Sofol Digital and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use TuckTime in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works from the Service except as permitted by law.
9. Privacy
Our Privacy Policy explains what we collect and how we handle it, including our minimisation of children’s data and our use of first-party-only analytics with no advertising or cross-app tracking. By using TuckTime you also agree to the Privacy Policy.
10. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the fullest extent permitted by law — including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or that stories or recordings will always be available. Nothing in these Terms excludes rights you have under mandatory consumer laws that cannot be excluded (for example, the Australian Consumer Law).
11. Limitation of liability
To the fullest extent permitted by law, Sofol Digital will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, recordings, profits, or goodwill, arising from or related to your use of the Service. To the fullest extent permitted by law, our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or US$50. Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.
12. Indemnity
You agree to indemnify and hold Sofol Digital harmless from claims, damages, and reasonable expenses arising from your misuse of the Service, your content, or your breach of these Terms, to the extent permitted by law.
13. Termination
You can stop using TuckTime and delete your account at any time from within the app. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. Sections that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and governing law) survive termination.
14. Changes
We may update the Service and these Terms from time to time. We’ll update the “Last updated” date and, for material changes, provide a more prominent notice. Continuing to use TuckTime after changes take effect means you accept the revised Terms.
15. The Apple App Store
These Terms are between you and Sofol Digital only, not with Apple. The following apply because you obtained TuckTime through the App Store:
- Apple has no obligation to provide any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims by you or a third party relating to the app or your use of it — including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar laws. Those are our responsibility, not Apple’s.
- If a third party claims the app infringes its intellectual-property rights, Sofol Digital (not Apple) is responsible for the investigation, defence, settlement, and discharge of that claim to the extent required by these Terms.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms of agreement when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
16. Governing law
These Terms are governed by the laws of Australia, without regard to conflict-of-law rules, and you agree to the non-exclusive jurisdiction of the courts located there — except where mandatory local consumer law gives you the right to bring proceedings, or requires a different governing law, in your own country of residence.
